Terms of use
The terms for the Hush Machine app and hushmachine.com: Apple’s licence, one-time purchases, the free trial, safe listening and contact.
These terms cover the Hush Machine app and hushmachine.com, made by Kallos Labs (“we”). By using the app you agree to them.
Apple’s terms
Hush Machine is licensed to you through the App Store. Apple’s Licensed Application End User License Agreement (the standard EULA, at apple.com/legal/internet-services/itunes/dev/stdeula) applies, together with these terms. If they conflict, Apple’s EULA wins. Apple is not responsible for the app or its support; we are.
Purchases and the free trial
Hush Machine Plus, sound packs and Lifetime are one-time purchases, not subscriptions. They are sold and billed by Apple, and refunds are handled by Apple under its policies (reportaproblem.apple.com). Lifetime includes Plus and every sound pack, including packs released later. The free trial of Plus lasts 3 nights and ends by itself: nothing is charged after it. Restore your purchases on a new device with the same Apple Account from Settings in the app.
Listening safely
Keep the volume at a comfortable, low level, especially with headphones and for long listening. For babies, keep the sound quiet and the device away from the cot, and follow the published advice for parents. Hush Machine is not a medical device and does not diagnose, treat or cure anything; Ears mode may make ringing in the ears less noticeable but is not a treatment. For a medical question, ask a doctor.
Your recordings
Only record sounds you have the right to record. Your recordings and mixes are yours; we don’t receive them.
Acceptable use
Don’t copy, resell or reverse engineer the app, or use shared links to send unlawful content.
No warranty
The app is provided “as is”. We work hard to make it play reliably all night, but we can’t promise it will be error-free or that it will always play, for example if the phone runs out of battery or iOS stops the app.
Limitation of liability
To the extent the law allows, Kallos Labs is not liable for indirect or consequential losses from using the app. Nothing here limits rights you have under consumer law.
